These Terms of Service (hereinafter "ToS") govern access to and use of the Bookelya platform (hereinafter "the Platform"), published by Nowave (Brûsk Kurt), whose registered office is located at: Rue des Guillemins 139, Liège 4000, Belgium.
By creating an account or using the Platform, the user accepts these ToS without reservation. If you do not accept these terms, please do not use the Platform.
Bookelya is a SaaS application for online management and booking aimed at beauty professionals (hair salons, beauty institutes, barbershops, spas, nail salons, aesthetic centers).
The Platform notably allows:
Any beauty professional can create an account by providing the required information (establishment name, email, password). The professional undertakes to provide accurate information and to keep it up to date.
End clients can create an account to manage their bookings. Account creation is free.
Each user is responsible for the confidentiality of their login credentials. Any activity carried out via their account is presumed to be performed by them.
Bookelya offers different subscription plans, including a free plan with limited features and paid plans with advanced features.
Current rates are displayed on the Platform's pricing page. Prices are shown excluding taxes unless otherwise stated.
Subscription payment is made according to the terms indicated upon subscription. In case of non-payment, access to paid features may be suspended.

All elements of the Platform (design, code, texts, logos, trademarks) are the exclusive property of Nowave or its partners. Any unauthorized reproduction, representation or exploitation is prohibited.
Content published by users (photos, service descriptions) remains their property. By publishing it on the Platform, they grant Bookelya a non-exclusive license to display it as part of the service.
The Platform is provided "as is". Nowave strives to ensure the availability and proper functioning of the service but does not guarantee uninterrupted availability.
Nowave shall not be held liable for any indirect damages, loss of data, revenue or clientele resulting from the use or inability to use the Platform.
Nowave is not a party to contractual relationships between professionals and their clients. Liability for beauty services rests exclusively with the professional.
The user may terminate their account at any time from their account settings or by contacting support.
Nowave reserves the right to suspend or delete an account in case of violation of these ToS, after prior notification when circumstances permit.
In case of termination, user data will be retained in accordance with the privacy policy before final deletion.
Nowave reserves the right to modify these ToS at any time. Users will be informed of any material modification. Continued use of the Platform after notification constitutes acceptance of the new terms.
These ToS are governed by Belgian law. In case of dispute, the parties will seek an amicable solution. Failing that, the competent courts of Belgium shall have sole jurisdiction.
